These Terms of Use cover your use of the Kept Staffed website at https://keptstaffed.com.
By using the site or sending the form, you agree to these terms. If you do not agree, please do not use the site.
Our Privacy Policy is at https://keptstaffed.com/privacy. It explains how we handle your information.
Who the site is for
The site is for business owners and managers who want help with hiring and daily tasks. You must be an adult to send the form.
If you send the form for a business, you confirm that you are allowed to act for that business.
Our service has its own agreement
Kept Staffed places a dedicated, trained assistant with a business owner. The assistant runs the hiring for that business every day. Depending on the plan, the assistant also handles daily tasks such as calls, follow-ups and admin.
The site describes that service and lets you ask for an intake call. What the site says about the service is general information. It is not legal, tax, financial or employment advice. It is not a contract for the service.
Sending the form does not make you a client. You become a client only when you and Kept Staffed both accept a written client agreement. That agreement sets out the service, the price and what each side must do. We may decline a request.
If the site and your client agreement say different things about the service, the client agreement applies.
Prices shown on the site
The site shows our monthly prices. This is what the site says about pricing:
- Plans are month to month.
- Founding clients pay no setup fee.
- Founding clients lock their rate for 6 months.
- Job ad spend is not part of our price. You pay it directly to the ad platforms.
When the site says no contracts, it means there is no long-term commitment. The service is month to month under a client agreement.
Your client agreement sets your actual price and conditions. We may change the prices shown on the site at any time. We may close founding client pricing to new clients at any time.
If a price or detail on the site is wrong, we may correct it.
Cost calculator and comparison
The site has a cost calculator and a comparison with a local hire. Both are estimates. They are there to help you think about cost.
The calculator uses the hourly wage and schedule you choose. The comparison uses a wage range shown on the page. Both add an assumed rate for employer payroll taxes. They leave out costs such as recruiting, training and benefits. Your real costs may be different.
An estimate is not a quote. It is not a promise of savings.
No promise of results
The site describes how our service works. That includes our standard of contacting every applicant within 15 minutes. That standard is about people who apply for a client's jobs. It is not a reply time for requests sent through the site.
Your client agreement sets out what we commit to for your business.
Hiring depends on things we do not control, such as your local job market, the pay you offer and the job itself. We do not promise a number of applicants or hires. We do not promise a date for filling a job.
Timeframes on the site are estimates.
Rules for using the site
Use the site only in ways the law allows. You agree not to:
- Send false or misleading information
- Send the details of another person without their permission
- Use bots, scripts or other automated tools to send the form or copy the site
- Try to get around the security check or any other protection
- Try to break into, damage or overload the site, its systems or its data
- Send viruses or other harmful code
- Use the site to send spam or advertising
We may block access or ignore a form request if we believe these rules were broken.
What you send us
You are responsible for what you send through the form. Make sure it is accurate and that you have the right to share it.
Do not send sensitive details, such as Social Security numbers, bank details or health information.
Our Privacy Policy explains what we collect and how we use it. It also explains how we may contact you by phone, text and email, and how to stop it.
If you send us ideas or feedback about the site or the service, we may use them without owing you anything.
Our content
The site and everything on it belong to Kept Staffed or to the people we license it from. That includes the text, graphics, layout, calculator, the Kept Staffed name and the logo.
You may view the site, share links to it and print pages for your own business use. Do not copy, republish, sell or reuse site content without our written permission. The same goes for our name and logo.
Names of other companies on the site, such as job ad platforms, belong to their owners. Naming them does not mean they sponsor or endorse Kept Staffed.
Other websites and companies
The site names other companies and may link to other websites and services. We do not control them and we are not responsible for their content, prices or practices. Your use of them is covered by their own terms.
Site availability
We may change, pause or remove the site or any part of it at any time, without notice. We do not promise that the site will always be available or free of errors.
The site comes as is
The site is provided as is and as available. You use it at your own risk.
To the fullest extent the law allows, we make no warranties about the site, stated or implied. That includes implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not promise that the site is accurate, complete, current or secure.
This section is about the site. Any commitments about the service are in the client agreement.
Limits of liability
To the fullest extent the law allows, Kept Staffed is not liable for indirect losses from your use of the site. The same goes for incidental, special, consequential and punitive damages. It also goes for lost profits, lost income, lost data and lost business.
These limits apply to loss from relying on the content, prices or estimates on the site. They also apply to loss from the site being unavailable, or from the website or service of another company.
Some laws do not allow some of these limits. In that case, the limits apply only as far as the law allows. Nothing in these terms limits liability that cannot be limited by law.
This section is about the site. Liability for the service is covered by the client agreement.
Changes to these terms
We may update these terms. We will post the new version on this page and change the effective date at the top.
The new version applies from the date it is posted. If you keep using the site after that, you accept the new terms.
Other points
If a court finds that part of these terms cannot be enforced, the rest still applies.
If we do not enforce a term right away, we can still enforce it later.
These terms are the whole agreement between you and Kept Staffed about the site. A client agreement is separate and covers the service.
